With the growing complexity of the NACHA Rules, interpretation of them becomes more of a challenge. This session takes the plunge into some interesting application-based Rules interpretation issues. Does a Rules violation automatically trigger liability?  Are third-party funds transfer agents operating within the Rules, or in violation of them? How does the Rules interpretation process work? What can you alter by agreement within the Rules? This session will explore these and other timely issue to help you avoid risk and improve compliance. 

ACH Origination Agreements: The Building Block to be a Successful ODFI

This session will show how proper ACH agreements can help grow your business and reduce your risk as an ODFI. Each ACH payment is covered by a myriad of rules that support the legal frame work under which the payment may be handled. Attendees will gain insight on the various rules and regulations that apply to both the origination and receipt of ACH payments. Now that Rules Simplification has been commented on and balloted what is next for the ACH Rules? NACHA staff will go over the 2010 Rules Plan of Work. Issues ranging from extended return timeframes to mobile payments and improvements to the check conversion process are in the works. Hear what NACHA’s plans are for the network as well as information on direct access registration requirements.

Cybercrime Risks and Controls

This session will address the risk management issues that arise from cybercrimes involving keylogging and phishing. As instances of this type of fraud increase, financial institutions and companies engaged in electronic commerce must respond to the threat with an integrated mix of awareness, prevention, appropriate reactions. The speaker will describe the current risk environment, review effective ways to mitigate the risks, and discuss how this threat influences the way we think about risks and controls. A case study will illustrate some of the key points, followed by time for questions and answers.

ACH Rules and Regulation E: Are There Issues that Still Need to be Addressed?

Over the last couple of years the NACHA rules have been revised to include major changes to the stop payment process in order to be more aligned with Regulation E. Attendees in this session will get a review of the 2007 Staff Interpretation changes to Regulation E along with a current check list of what NACHA rules have changed.  We will also look at the outstanding issues that still remain including similarly authenticated standards and notice requirements for service fees related to bad checks.
